SMS POLICY

Stem Cells Colombia uses SMS messages and phone calls responsibly to communicate with patients about appointments, treatments, and health updates while fully complying with Colombian laws. This policy ensures patient privacy and consent under Ley 1581 de 2012 and Superintendencia de Industria y Comercio (SIC) regulations, including fixes for Error 3049 consent flow validation.

Legal Compliance

All SMS communications and phone calls adhere to Ley 1581 de 2012 on data protection, requiring explicit prior consent for any commercial or promotional use of phone numbers. Forms validated server-side to ensure checkbox selection before phone submission. We respect Ley 2300 de 2023 restrictions, prohibiting messages on Sundays, holidays, or outside 7am-7pm weekdays and 8am-7pm Saturdays (calls follow similar time restrictions). Numbers registered in the Registro Nacional de Excluidos (RNE) via CRC receive no commercial SMS or calls.

The brand captures SMS consent via the contact form on https://stemcellscolombia.com/contact-us/. The form features a clear, non-pre-ticked checkbox for SMS opt-in. Our Privacy Policy (Section 4) and dedicated SMS Policy explicitly state that mobile information and SMS consent data are never shared with third parties for marketing purposes. The opt-in includes ‘STOP’ to cancel instructions.

Consent Capture Details (SIC Error 3049 Compliance)

  1. All forms include a dedicated phone field where clients voluntarily enter their number.
  2. Mandatory checkbox with exact text: “I accept receiving text messages and phone calls (Stem Cells Colombia). Does not apply to verification.”
  3. “Y” SMS verification: Clients reply “Y” to: “Stem Cells Colombia: Reply Y to confirm consent for messages and calls. Business: Stem Cells Colombia.”
  4. No third-party sources: Numbers obtained only via direct forms/“Y” method or web review. We do not share/sell data with third parties.
Consent logs include: date, IP, method, exact checkbox text, “Y” reply proof. Stored 5+ years for SIC audits.

Types of SMS Sent

  • Appointment reminders and rescheduling (e.g., “Your stem cell session is tomorrow at 10am. Reply CANCEL to opt out.”).
  • Treatment follow-ups (e.g., post-therapy care instructions).
  • Urgent health alerts (e.g., protocol updates for anti-aging or pain relief therapies).
Promotional SMS about new protocols like full-body rejuvenation require separate opt-in.
Phone calls used for urgent confirmations, detailed consultations, or when SMS insufficient (e.g., complex treatment scheduling).

Sharing Your Information

Mobile information will not be shared with third parties/affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Consent Process

Patients provide explicit opt-in via website forms, intake paperwork, or double-opt-in SMS (e.g., “Reply Y to receive clinic updates and calls from Stem Cells Colombia.”). We store proof of consent including date, method, and IP address. Minors’ data requires legal representative consent per health regulations.

Opt-Out and Data Management

Every SMS includes: “Reply STOP to unsubscribe” or a link to our privacy policy at https://stemcellscolombia.com/. For calls, patients can opt out via reply, form, or direct request. Opt-outs are processed immediately, within 24 hours maximum, and numbers are added to our do-not-contact list. We maintain secure, updated databases per Ley 1266 de 2008, with regular audits.

Message Content Rules

Messages are concise (under 160 characters), personalized using merge fields (e.g., patient name), and free of sensitive health details to protect confidentiality. No spam: limited to 1-2 relevant messages weekly, focused on regenerative treatments like exosomes or hyperbaric sessions. Calls are brief, scripted, and logged for quality.

Staff Guidelines

  • Confirm patient mobile numbers during consultations.
  • Use approved templates only for SMS; follow call scripts for phone contact.
  • Log all sends and calls with responses.
  • Report issues to compliance@stemcellscolombia.com.
Violations trigger internal review and SIC reporting if needed.

Updates and Enforcement

This policy reviews annually or with legal changes, effective March 18, 2026. Violations by staff may result in disciplinary action; patients can report to SIC.
